Biy Courts in Traditional Kazakh Society (18th-19th Centuries)

XVIII-XIX. yüzyıllarda Kazakların toplumsal ve ekonomik ilişkilerindeki hukuki anlaşmazlıkların çözümünde biy (kadı, hakim) denilen geleneksel yargıçların etkin bir rol aldığı görülmektedir. Kazaklarda yargısal süreçlerin adli-idari ilişkilerin düzenlenmesinin temelini atan Kasım Han’ın oluşturduğu Hanın Kaska Jolı=Kasım Doğru Yolu yasası ile bu yasayı daha da geliştirerek hale getiren Esim Eski Jolı=Esim Tavke Jeti Jargı=Yedi Yargı” olduğu bilinmektedir. Oluşturulan yasalarda Biy Mahkemeleri, yalnızca yargı görevini yürütmekle sınırlı kalmamış aynı zamanda Kazak toplumunun adlî idarî işlerinden yetkili merci de yürütmüştür. Biyler, göçebe yaşamında devlet kurumlarının işleyişinin şekillenmesinde gücünü elinde tutan önemli mevkide yer almışlardır. Bu çalışmada, toplum yapısında biylerin ortaya çıkışı, mahkemesinin gelişimi karakteristik özellikleri üzerinde durulmuştur.
